The following policies are enforced at Cain's Murray Auto Auction, Inc.

                                                            Auction Rules

General Rules

  1. All dealers must be registered at this auction before doing business.
  2. All units purchased and/or sold on premises must be paid for through the auction office the day of the sale.
  3. All sales not sold across the block or sold outside on the auction lot are “As-Is” and are not to be arbitrated by the auction.
  4. DEALERS ONLY!! – NO RETAIL CUSTOMERS!!
  5. Cars selling for $1500 or less are “as-is” and are not subject to arbitration.
  6. All cars must have a gate pass before leaving the premises.
  7. All ten (10) year old vehicles – miles are federally EXEMPT.
  8. All vehicles re-billed through the auction will cost extra fees.
  9. 100,000 mile vehicles are auction guarantee ONLY!

a). motor, rearend and transmission ONLY

b). ABS, Air Bag & Check Engine lights can NOT be arbitrated if Auction Guarantee

  1. Vehicles must be arbitrated within (1) hour after the last vehicle sold for the night.  Arbitration minimum is $250.
  2. “IF” sales are strictly between the buyer and seller and not binding on either until sales are consummated.
  3. Current year models shall be free of major visible defects, but minor refinishing or minor dents shall not be grounds for rejection.
  4. FRAME DAMAGE covers only current year plus 6 years prior!
  5. When “title attached” is not announced at the block, buyer has the right to reject the car.
  6. No vehicle will be offered for sale without a serial plate or proper verification.
  7. Odometer mileage:  The auction assumes absolutely no responsibility for odometer mileage or the validity of the mileage statement provided by the seller to the buyer. (see Seller’s Responsibility #5) (See NAAA Seller Disclosure Requirements Time Periods)
  8. Any dealer refusing to honor a check to Cain’s Murray Auto Auction will be placed on hold immediately and reported to Auction Insurance Agency. CMAA will prosecute for any unresolved NSF or stop payment items.  A $100 fee will be assessed for all returned checks.
  9. THE AUCTION IS NOT RESPONSIBLE FOR IMPROPER ODOMETER OR MODEL ANNOUNCEMENTS.  WINDOW DESCRIPTIONS ARE OFFERED AS A COURTESY ONLY. 
  10. Cain’s Murray Auto Auction uses AutoCheck exclusively and does NOT recognize any other reporting agencies.

 

Buyer’s Responsibility

  1. Buyer is responsible for verifying the year and mileage reading on all purchases before leaving the sale.
  2. It is the buyer’s obligation to watch lights and listen to announced “conditions”.
  3. Know what you are buying!! Rejects without cause are NOT tolerated.  Complaints must be handled through Arbitration Only! 

Frame Damage cars must be reported to the auction NO later than seven (7) days after the date of sale.  (See NAAA Seller Disclosure Requirements Time Periods)

  1. The auction is not responsible for warranty books or plates.
  2. The auction does not guarantee the year of any house trailer, motor home, boat, boat motor, antique truck, dune buggy, or motorcycle.  Satisfy yourself before settlement, as the auction will NOT become involved in any subsequent dispute.
  3. Watch the lights!!! If you do not know why a certain light is on, please ask the auctioneer!
  4. Spare tires are the responsibility of the buyer.  Buyers are urged to inspect the trunk before bidding.
  5. There will be a $100 surcharge charged to the buyer for deposited bank drafts.
  6. There will be a $25/day late fee for all purchases with titles and/or off-float deals.
  7. On ALL “Auction Guarantee” Vehicles – a). NO arbitration on driveline slack b). NO arbitration on coolant leaks c). NO arbitration on oil leaks.
  8. On ALL Ford Explorers and ALL Jeeps that are “Auction Guarantee” there will be NO arbitration on drive train noise!!!

 

Seller’s Responsibility

  1. It is the seller’s obligation to correct any errors made by the auction as to announced “conditions”.
  2. All salvage titles and reconstructed titles must be announced.  (See NAAA Seller Disclosure Requirements Time Periods)
  3. Cars with repaired, damaged or mended frames are not acceptable for sales unless announced! (See NAAA Seller Disclosure Requirements Time Periods)
  4. The auction is NOT responsible for warranty books or plates.
  5. Odometer mileage:  Sellers must announce from the block the following:

a)      If the odometer is not working properly

b)      If he has ANY knowledge that the mileage is different than the mileage on the odometer.

  1. Motor home or dune buggy:  seller must announce from the auction block the year of the chassis and the year of the unit.
  2. Diesel conversions must be announced. (See NAAA Seller Disclosure Requirements Time Periods)
    8.   It is the seller’s responsibility for verifying the year & mileage reading on vehicle.

LIGHTS SYSTEM

        Green Light- “Ride and Drive” (“R/D”)

Seller guarantees the vehicle not to have any single defects costing more than $250 to repair.  Excluding obvious visible exterior defects including body damage, hail damage, or broken glass (See NAAA Seller Disclosure Requirements Time Periods)

 

          Yellow Light- “Conditions Announced” or “Auction Guarantee”

Vehicles sold with pre-announced declarations that are not subject to arbitration.  Or seller only guarantees the motor, rear-end and transmission.  100,000 mile vehicles are sold “Auction Guarantee” ONLY (See NAAA Seller Disclosure Requirements Time Periods)

 

Red Light- “As-Is”

Vehicle is sold with NO “ride and drive” or “auction guarantee” and may not be arbitrated except for odometer discrepancy, flood damage, title discrepancy or frame damage.  Cars selling for $1500 or less are “As-Is”. (See NAAA Seller Disclosure Requirements Time Periods)

 

Blue Light- “Title Absent” (“TA”)

Title is absent at the time of sale.  The seller has thirty (30) days from the date of sale to produce a negotiable title.  After the 30-day period, it is the Buyer’s option to return the vehicle or to wait a reasonable period for the title.
